TERMS AND CONDITIONS

General

The General Terms and Conditions apply to all services and products offered by LOVE OVER FEAR (hereinafter referred to as the "supplier") on www.loveoverfear.studio or provided to, delivered to and sold to the customer or buyer.

Deviating provisions shall only apply if they have been expressly agreed in writing between the supplier and the customer. By filling out and sending the order of the corresponding products, the customer accepts these terms and conditions.


Special or general contractual conditions that contradict these GTC are not accepted by the supplier and are not valid in the relationship between the supplier and the customer. Individual agreements take precedence over these GTC.

By placing an order with the supplier, the buyer acknowledges the version of the GTC valid at the time of the order as an integral part of the contract. The supplier reserves the right to amend the GTC at any time.

Conclusion of Contract

The contract between the customer and the supplier is concluded by sending the order in the online store. The content and scope of the service are set out in these GTC or in any individual agreements.

Unless limited in time, offers are always subject to change without notice until the conclusion of the contract, in particular with regard to prices, delivery obligations, quantities and times.

Prices

Prices are quoted in US dollars. The list prices of the supplier valid on the day of delivery shall apply.

Shipping

Orders are shipped from the United States.  Normally, orders from the US are shipped within 2-5 business days and orders from the rest of the world within 10-30 business days, but it may take longer due to unforeseen circumstances. Due to environmental sustainability we produce the garments from the time we receive the order.

With the handing over of the goods to the post office or the parcel service, at the latest, however, with leaving the manufacturer's building, the transport risk is transferred to the purchaser. Stolen / lost packages are non-refundable. Transport damages are to be reported immediately to the corresponding post office. Certain misunderstandings may apply but evidence must be recorded, please contact orders@loveoverfear.studio and we will try our best to assist you with this matter.

The customer is obliged to accept the delivered goods. The delivery and any subsequent deliveries shall be made exclusively outside Switzerland. The supplier expressly reserves the right to supply certain buyers only by prepayment without further justification.

All international orders are shipped Delivered Duties Unpaid (DDU). This means that you, the customer, are responsible for paying your local country's import duties at time of delivery. Placing an order to an international destination serves as confirmation that you understand your responsibility to pay these fees. Unfortunately, we are unable to calculate these fees at time of purchase.

If the supplier is unable to fulfill its delivery obligations due to operational disruptions, labor shortages, strikes, failure to deliver to the supplier, fire damage, armed conflicts, official decrees, significant changes in currency conditions or as a result of force majeure, the supplier shall be released from its obligation to perform.

The purchaser may only derive a claim for damages from late or delayed delivery if the supplier can be charged with intent or gross negligence. If the supplier should be obliged to pay damages, the amount of liability shall be limited to the net invoice value. Lost profits, consequential damages and damages to third parties will not be compensated.

Returns & Exchanges

Returns are not supported for orders of wrong size, color or if you do not like the product. In certain situations, we may be able to exchange damaged or mismanufactured items for the proper item for free within 30 days of the order being placed. You can contact orders@loveoverfear.studio to initiate your exchange. All returned items must be in new unworn condition with tags still attached. Returned items received in any other condition will be sent back at your expense unless otherwise agreed upon.

Payment

We offer the payment options credit card, PayPal and Apple Pay.

Warranty

The supplier guarantees that the sales products are handed over free of material defects and defects of title.

Any defects must be reported to the supplier immediately, at the latest within 30 days, in writing or by e-mail. The supplier shall not be liable for any damage caused to the products after delivery due to non-compliance with the supplier's operating or care instructions. The buyer is responsible for proving that the goods were defective at the time of delivery.

If the purchaser asserts justified warranty claims, the supplier can deliver replacement goods. Further claims due to defective delivery, in particular claims for damages including loss of profit or due to other financial loss of the purchaser, are completely excluded, unless the cause of damage is based on intent or gross negligence of the supplier.

Data Protection

The supplier shall take all reasonable measures to protect the data stored with it. Access to stored data by third parties at the supplier or a contractual partner of the supplier shall not result in liability on the part of the supplier and its contractual partners.

The supplier uses customer data to fulfill the services offered in accordance with the contract and the law, to maintain the customer relationship and to submit offers.

The customer fully agrees to the storage and use of his data by the supplier. The customer may prohibit the use and processing of his data for marketing purposes at any time.

Applicable Law, Place of Jurisdiction

The GTC and the legal relationship between the supplier and the customer are subject to Swiss law. The exclusive place of jurisdiction is at the registered office of the supplier.
